Terms of service
This translation is provided for convenience. The German version is legally binding.
1. Provider and scope
These terms apply to the use of ClickAndSay at clickandsay.com. The provider is Shalom Dov-Ber Kirsh, Wild Digital Moments, Streleweg 18a/Top 20, 6460 Imst, Austria (see imprint).
2. Service
ClickAndSay is a feedback tool for websites and 3D models. Customers (agencies, freelancers, site owners) create projects in their account and give their own clients or teams a feedback link. Through that link, comments are marked up directly on the page. The features and limits of each plan are listed in the pricing section on clickandsay.com.
3. Account and access
You need an account to use ClickAndSay. Keep your login details confidential. People who give feedback through a feedback link need no account and no installation. A feedback link is meant only for the people working on that project and must not be shared publicly.
4. Trial, prices and payment
New accounts can try ClickAndSay free for 14 days, without payment details. The trial ends on its own. A paid subscription only starts if you choose a plan and pay for it.
The prices in the pricing section at the time of ordering apply, in euro. As a small business under §6 (1) no. 27 of the Austrian VAT Act (UStG), Wild Digital Moments charges no VAT. A subscription is paid monthly or yearly in advance through the payment provider Mollie B.V. and renews automatically for the same period until it is cancelled.
5. Cancellation
You can cancel your subscription at any time with one click in your account. The period you have already paid for runs until its end; after that nothing more is charged. You can delete your account at any time. A running subscription is cancelled first.
6. Content
Your projects, markups and uploaded images and models belong to you. Don't upload anything unlawful, or anything protected by someone else's copyright that you are not allowed to use.
7. Availability
ClickAndSay is provided as part of your subscription, without any guarantee of uninterrupted availability.
8. Data
The privacy policy applies. The feedback data in your projects is covered by the data processing agreement (Art. 28 GDPR) you conclude when signing up. Feedback data is deleted up to 90 days after a project ends.
